(RALEIGH) -- Duke Energy Corp. has asked the North Carolina utilities commission to postpone for at least two weeks testimony from two of its directors.
The commission last week ordered Duke Energy board members Ann Maynard Grey of Stamford, Conn., and Michael Browning of Indianapolis to testify on Friday. Duke Energy told the North Carolina Utilities Commission Tuesday that the regulatory body doesn't have the authority to subpoena out-of-state residents.
On Thursday, the commission will hear from ousted CEO Bill Johnson as well as two Duke board members, James Hyler Jr. and E. Mari McKee, both of whom sat on the old Progress Energy board and voted against Johnson's ouster.
State regulators want to know whether they were misled when Duke Energy replaced its chief executive within hours after taking over Progress Energy. The companies said for over a year that Progress CEO Bill Johnson would lead the company.
Meanwhile the Florida Public Service Commission has invited Duke Energy CEO Jim Rogers to an Aug. 13 status update on the broken Crystal River nuclear plant,. Rogers said he will appear.
Rogers told the North Carolina Utilities Commission July 11 that Duke conducted its own study of the Crystal River nuclear plant's troubles prior to the merger. The management of the utility's sole nuclear plant in Florida was part of the reason former Progress CEO Bill Johnson lost his job as head of the combined company.
