NCAE wins injunction on legislation |

(RALEIGH) -- The state's largest teacher's association has won an early round against state legislators. An injunction has been issued by a judge blocking the legislative veto override that stopped NCAE dues from being deducted from teacher's paychecks.
NCAE president Sheri Strickland said the legislation required them to act quickly. "Once the legislation was passed it was to take effect immediately so it would have impacted, for most of our members, their January paycheck which comes at the end of the month," said Strickland.
The attorney for the NCAE, former state Supreme Court justice Bob Orr, said it was the post-midnight session that produced the legislation that was unlawful. "Our argument was that the joint resolution violated the constitution and therefore that session was not only invalid but obviously the legislation was void," said Orr.
The NCAE claims lawmakers singled the organization out because of its vocal opposition to massive education cuts in the most recent state budget.
